CHARTER CONDITIONS FOR GULETS
To the best of knowledge the Owner/Capitan certifies the Yacht duly complies with satisfactory safety regulations and yacht charter conditions applied in the above stated sailing area with qualified crew and appropriate service.
CLAUSE 1 AGREEMENT TO LET
The Owner agree to let the Yacht to the Charterer and not to enter into any other agreement for the Charter of the Yacht for the same period.
CLAUSE 2 DELIVERY
The Owner shall at the beginning of the Charter deliver the Yacht to the Port of Delivery and the Charterer shall take delivery in full commission and working order,seaworthy, clean, in the good condition throughout and ready for service, with full equipment ,including up- to-date safety and life –saving equipment (including life-jackets for children if any, and part of the Chaterer's party), as required by the Yacht's registration authority.
CLAUSE 3 MAXIMUM NUMBER OF PERSONS
The Charterer shall not at any time during the Charter period permit more than the maximum number of guest sleeping or cruising on bord here in stated. As an exception ,a reasonable number of visitors could be on board whilst the yacht is securely moored in port and at the sole discretion of the captain.
CLAUSE 4 CREW
The Owner shall provide the Crew of the Yacht, according to the laws of Croatia and properly uniformed , fed and insured. The Owner shall ensure that Captain and Crew comply with the laws and regulations of any country into whose waters the Yacht shall enter during the course of this Agreement.
CLAUSE 5 DAMAGE/LOSS
In case of some damage /loss the parties to the agreement will agree upon the adequate indemnity from /to the client.
All damage has to paid direct from clients in the end of cruising.
CLAUSE 6 PAYMENT
a/first payment 50%after signing the booking form-
b/45 days before the charter
CLAUSE 7 OWNER OBLIGATIONS
The Owner Company will give service s according to the agreement and to the general charter conditions
CLAUSE 8 FORCE MAJEURE
The Owner cannot accept liability for war or terrorist activity, roits. industrial disputes, natural disasters, fire, adverse weather condition, or any other force majeure events that are beyond the control of the owner.
CLAUSE 9 ITINERARY
The Owner reserves the right to change the itinerary if for any reason think a certain destination is not suitable.
The Captain has final decision on this matter.
CLAUSE 10 ARBITRATION
Any dispute in connection with the interpretation and fulfilment of this Agreement shall be decided by arbitration in Zagreb Croatia. Each party shall appoint one Arbitrator .This Agreement shall be interpreted and fulfilled in accordance with Croatian Law.
CLAUSE 11 CANCALATION BY CLIENT
Cancellation policy/days prior to cruise-cancellation fee:
180 days and more......................25% of total charges
90-179 days..............................50% of total charges
89-57 days ...............................60% of total charges
56-29 days ...............................80% of total charges
Within 28 day s.........................100% of total charges
CLAUSE 12 CANCELLATIONS BY OWNER
The owner will do its utmost to provide the contracted yacht but it unforeseen circumstances arise and an acceptable alternative cannot be provided, the Owner may find it necessary to cancel your holiday before departure In this case Owner will return all money paid by Charterer
The Owner will then be under no father obligation or liability.
